The criminal court procedure following an arrest for a Mission Viejo DUI has nothing to do with the DMV hearing.  A set aside on the potential suspension through the Department of Motor Vehicles does not guarantee a dismissal in court.  The criminal court case begins at the arraignment phase.  Your arraignment date or first court date is generally listed at the bottom of your yellow citation issued to you immediately following release from arrest.  You are required to appear at your arraignment date unless you hire a Mission Viejo DUI defense attorney to represent you.
